Terms of Use

These terms apply to your use of Cup & Dial: the iPhone app, the web app at cupanddial.com and the service behind them. By creating an account or using Cup & Dial, you agree to these terms and acknowledge our Privacy Policy. Please read them. If you don’t agree, don’t use Cup & Dial.

1. Who we are

Cup & Dial is run by Thomas Nairn, an individual based in the United Kingdom (“we”, “us”). You can contact us at privacy@cupanddial.com.

2. The website is in beta

The website is in beta and is available for public catalogue browsing only. Account creation, sign-in and personal journals are accessed through the iPhone app. Website features may change as we prepare account access for a future web release. Please tell us about anything that goes wrong at support@cupanddial.com.

3. Who can use Cup & Dial

  • You must be 18 or older to create an account or use Cup & Dial. If we learn that an account belongs to someone under 18, we will close it and delete its information.
  • Keep your sign-in details secure and don’t share your account. You are responsible for what happens on your account. If you think someone else is using it, tell us at privacy@cupanddial.com.
  • Give accurate information when you create your account, and choose a username that follows the community rules below.

4. The service

Cup & Dial is a coffee journal with a shared, community-built catalogue of coffees, roasters, producers, farms, cafés, recipes and gear. The service is currently free. We work to keep it running well, but we can’t promise it will always be available or free of errors, and we may change, pause or end features. If we plan to shut Cup & Dial down, we will give you reasonable notice so you can request a copy of your data.

5. Your content

  • You own what you create. Your journal, photos, reviews and submissions stay yours.
  • Your public profile: unless your account is anonymous, choosing a username makes your username, optional display name, when you joined, selected spotlight content and published written reviews available on a public profile page. Anyone can open it through a shared link or your review handle without an account. Your private journal stays private. Enable “Anonymous account” in Settings → Account → Profile privacy to hide the profile and disable profile sharing.
  • Your journal: you let us store and process it to provide your journal and personal features. Subject to your recommendation preference and the notice and safeguards in our Privacy Policy, you also let us process selected details from synced brews to develop and improve brewing suggestions for you and other users. This does not give other users access to your individual logs.
  • What you share with the community: when you submit catalogue records, photos, corrections, ratings, tasting notes or reviews, you give us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and adapt them (for example resizing photos or combining ratings into averages), so they can be shown in Cup & Dial on any platform.
  • When you delete your account, your reviews, ratings and tasting notes are deleted. Catalogue records and photos that have already been published stay in the shared catalogue without your account attribution, and the licence continues for them, because other people’s journals and reviews depend on them.
  • Images you share from the app: share images, such as brew cards, are made on your device from your own journal and go wherever you send them. We don’t host or review them, and you are responsible for what they contain and where you share them. Don’t use them, or the Cup & Dial name and branding on them, for anything the community rules below don’t allow.
  • Only share content you have the right to share. Photos should be your own, or you should have permission to use them.

6. Community rules

Cup & Dial has no tolerance for objectionable content or abusive users. When you use community features, you must not post anything that:

  • is unlawful, defamatory, hateful, harassing, threatening, sexually explicit or violent;
  • includes someone else’s personal information, or impersonates a person or business;
  • infringes anyone’s copyright, trademark or other rights;
  • is spam, advertising, or misleading. Reviews must reflect a genuine experience: don’t review your own business or a competitor’s, and don’t post reviews in exchange for payment or free products without saying so;
  • is deliberately inaccurate about a coffee, roaster, producer, farm, café or piece of gear.

New coffees, roasters, producers, farms, gear, recipes and photos are checked by a moderator before they’re published. Written reviews appear straight away, unless they contain wording we filter, in which case a moderator checks them first. Anyone can report a review they think breaks these rules, and block its author so they no longer see that person’s reviews. A reported review can be hidden until a moderator decides. We aim to review reports within 24 hours. We may edit, decline or remove content, and suspend or close accounts that break these rules, without notice where that is needed to protect other people.

Illegal content and complaints. If you believe something on Cup & Dial is illegal, or you want to complain about a report we handled or about action we took on your content or account, email privacy@cupanddial.com with “Content complaint” in the subject. Include what the content is, where it appears, and why you are complaining. We will look into it promptly, remove illegal content we find, and tell you what we decided. If we removed your content or restricted your account and you think we got it wrong, you can ask us to look again the same way.

7. Acceptable use

Don’t misuse the service. In particular, don’t:

  • try to get around security, rate limits or access controls, or read other people’s private data;
  • scrape or bulk-download the catalogue, or use automated tools to access Cup & Dial beyond normal use of the apps;
  • disrupt or overload the service, or upload malware;
  • copy, reverse-engineer or resell the apps, except where the law allows it.

8. Information in the catalogue

Coffee details, ratings, reviews and recipes come largely from the community. We moderate submissions for accuracy, but we can’t guarantee every detail is correct or up to date, so check anything important, such as café opening times or a coffee’s availability, with the business. Reviews are the opinions of the people who wrote them, not ours. Brewing involves hot water and equipment, so follow your equipment manufacturer’s instructions.

9. Our content and other services

The Cup & Dial name, logo, design and software belong to us. You may use them only as part of using the service. Maps, café search and links to other websites are provided by other companies under their own terms. We aren’t responsible for their content or services.

10. Ending your use

You can stop using Cup & Dial and delete your account at any time from Settings → Account. We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal reasons. Where it’s reasonable to do so, we will tell you why.

11. Our responsibility to you

  • Nothing in these terms limits your rights under the Consumer Rights Act 2015 or any other law that can’t be excluded by agreement, including consumer laws where you live. We don’t exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t allow us to exclude.
  • Subject to those rights, Cup & Dial is provided “as is”. We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable.
  • Cup & Dial is for personal, non-commercial use. We are not responsible for business losses, such as lost profit or lost business opportunity.
  • Keep your own copies of anything important. We are not responsible for content you lose because of something outside our reasonable control.

12. The iPhone app and Apple

If you download Cup & Dial from the App Store, these terms are between you and us, not Apple. Also:

  • Apple has no responsibility for the app or its content, and no obligation to provide maintenance or support for it.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for the app.
  • We, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone else’s intellectual property.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you are not on any US Government list of prohibited or restricted parties.
  • You must also follow the App Store’s own terms, including its Usage Rules.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Changes to these terms

We may update these terms, for example when we add features or when the law changes. We will update the date at the top. If a change is significant, we will tell you in the app or by email before it takes effect. If you keep using Cup & Dial after that, the new terms apply. If you don’t agree to them, you can delete your account.

14. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales can hear any dispute about them. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live outside the UK, you keep any protection your local consumer law gives you, including the right to bring proceedings where you live. If you have a complaint, please email privacy@cupanddial.com first. We’ll try to resolve it.

If any part of these terms is found to be unenforceable, the rest still applies. If we don’t enforce a term straight away, we can still enforce it later.
